Terms of service
These Terms of Service (“Terms”) are an agreement between you and Cloth Climb LLC (“Cloth Climb,” “we,” “us”), a Missouri limited liability company. By using the website or placing an order, you agree to these Terms, the Privacy Policy, the Shipping Policy, the Refund Policy, the Payment Policy, and the Cookie Policy. If you do not agree, do not use the site.
The shop and the territory
The website is an online catalog and checkout for planters and related home goods. Sales are offered only to customers who can receive a shipment in the fifty United States or the District of Columbia. We may refuse or cancel an order that lists a ship-to address outside that territory.
Accounts and accuracy
You are responsible for the truth of the address, email, and payment details you enter. An apartment number left off a checkout form is the most common reason a planter carton stalls. We are not responsible for a delay caused by information you typed incorrectly.
Orders are offers
Clicking “place order” is an offer to buy, not an automatic acceptance. We may decline an order because an item is out of stock, because a price was posted in error, because a payment does not clear, or because the order looks fraudulent. If we decline, we do not keep the money.
Catalog descriptions
Dimensions, capacities, and finishes are described in good faith. Handmade and small-batch pieces vary. A glaze photograph is a guide, not a spectrophotometer reading. We reserve the right to correct a typo and, if the correction changes the deal in a material way, to cancel and refund before the carton ships.
Risk of loss
Title and risk of loss pass to you when the carrier receives the carton, except where a statute says otherwise and except for a damage claim we have accepted under the Refund Policy. Report transit damage using the process on that page.
Acceptable use
You may not misuse the site: scrape the catalog with a bot, probe the checkout for vulnerabilities, post malware, impersonate Cloth Climb, or use the shop to launder a payment. We may suspend access if we reasonably believe the Terms have been broken.
Limitation of liability
To the fullest extent permitted by law, Cloth Climb LLC is not liable for lost profits, lost plants, interior-design redo costs, or other indirect, incidental, special, or consequential damages arising from a purchase or from use of the site. Our total liability for any claim connected to an order is limited to the amount you paid for that order. Some states do not allow certain limitations; in those states, our liability is limited to the maximum extent the law allows.
No extra warranties
Except for the replacement and refund promises written in the Refund Policy, and except for any warranty that Missouri or federal law will not let us disclaim, the goods and the site are provided as they are. We do not warrant that a plant will thrive, that a finish will look identical under every light, or that the site will be uninterrupted.
Indemnity
If your misuse of the site, your inaccurate address, or your resale of a piece as something it is not causes a claim against Cloth Climb, you will defend and indemnify Cloth Climb LLC and its members against that claim, including reasonable legal fees.
Governing law
Missouri law governs these Terms. Disputes will be heard in the state or federal courts located in Missouri, except that you may bring an individual claim in small-claims court in your county if the claim fits that court’s limits. You and Cloth Climb both waive a class action to the extent a waiver is enforceable.
Changes
We may update these Terms. The date in the header is the date the current version took effect. If you place an order after that date, the new Terms apply to that order.
